Terms of Service

1. The Service

Novaali is an online tool that uses artificial intelligence to create 1980s-style images ("Outputs") from photos you upload ("Inputs"). Outputs are AI-generated artwork. They are not real photographs and may not accurately depict you, your appearance or any historical event.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is not directed to children, and you may not upload photos of anyone under 18.

3. Accounts

You are responsible for the accuracy of the information you give us, for keeping your login secure and for all activity under your account. Tell us immediately at support@novaali.shop if you suspect unauthorized use.

4. Credits

• One credit generates one image. Free previews are watermarked and limited to 1024 px.
• Credits are a limited license to use the Service. They have no cash value, cannot be transferred or resold and can only be used on novaali.shop.
• Credits from one-time credit packs do not expire while your account remains open.
• Credits included in a subscription are granted at the start of each monthly credit cycle and expire at the end of that cycle. Unused subscription credits do not roll over.
• If a generation fails for a technical reason on our side, the credits used are returned to your account.

5. Prices, payment and taxes

Prices are shown on our Pricing page in US dollars (USD). Applicable sales tax, VAT or similar taxes may be added at checkout, and the total is always displayed before you pay. Payments are processed by our payment providers (Stripe and PayPal) under their own terms; we do not receive or store your full card number. Charges appear on your statement as NOVAALI.SHOP.

6. Subscriptions and automatic renewal

If you buy a subscription (Basic, Pro or Studio), you authorize us to charge your payment method at the start of each billing period (monthly or yearly, as you selected) at the price shown when you subscribed. Your subscription renews automatically until you cancel. You will be asked to agree to these renewal terms before your first payment, and we send an email confirmation that includes how to cancel.

• You can cancel at any time online in Account > Billing, or by emailing billing@novaali.shop.
• Cancellation stops future renewals and takes effect at the end of the current billing period. You keep access and remaining cycle credits until then.
• For yearly subscriptions we email a reminder at least 7 days before each renewal.
• If we change the price of your subscription, we will notify you at least 30 days in advance, and the new price applies only from your next renewal. You can cancel before it takes effect.

7. Refunds

Refunds are handled under our Refund & Cancellation Policy, which forms part of these Terms. Nothing in these Terms limits any mandatory rights you have under consumer protection law.

8. Your Inputs

You keep all rights to the photos you upload. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, process and transform your Inputs solely to provide the Service to you. This license ends when your Inputs are deleted, which happens automatically within 24 hours of upload. We do not use your Inputs or Outputs to train AI models.

You confirm that you own or have permission to use every Input, that every person shown is an adult who has consented to the use of their image, and that your Inputs do not violate any law or anyone's rights.

9. Outputs and license

As between you and us, and to the extent permitted by law, you own the Outputs you create. Outputs created with free previews, credit packs and the Basic plan may be used for personal, non-commercial purposes. Outputs created on the Pro or Studio plan may also be used commercially. Because AI can produce similar results for different users, we cannot guarantee that Outputs are unique, and you are responsible for how you use them. You must not present Outputs as authentic historical photographs or use them to deceive anyone.

10. Acceptable use

You must follow our Acceptable Use Policy. In short: no sexual content, no minors, no photos of people without consent, no public figures, no impersonation, harassment, hate or illegal content. We may use automated and human review to enforce these rules.

11. Our intellectual property

The Service, including our software, style presets, website design, text, logos and the Novaali name, is owned by us or our licensors and protected by law. These Terms do not give you any rights to our brand or software other than the right to use the Service.

12. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you seriously or repeatedly breach these Terms or the Acceptable Use Policy, if required by law, or to protect users or third parties. If we terminate your account without cause, we will refund any unused prepaid amounts. Accounts terminated for abuse are not eligible for refunds except where required by law.

13. Disclaimers

The Service is provided "as is" and "as available". AI results vary and may contain inaccuracies or artifacts. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.

15. Indemnity

You agree to indemnify us against claims arising from your Inputs, your use of Outputs or your breach of these Terms, to the extent permitted by law.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules, except where the law of your country of residence gives you mandatory protection. Before filing any claim, please contact us at legal@novaali.shop so we can try to resolve it informally within 30 days.

17. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or on the website at least 14 days before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
